Terms of service

1. General Overview

These Terms and Conditions, along with the Privacy Statement, apply to your use of Club House products (Tags, Labels) and apps. If third-party services (like Google or Facebook) are used, their policies also apply. Club House is not liable for those third-party terms. Updates to these terms may occur; continued use means acceptance. Any deviation must be in writing. If a provision is invalid, others remain effective.

2. Definitions

• Website: clubhousemembers.com
• Consumer: Individual using Club House products and services
• Membership: Activated when Club House products are used
• Tags/Labels: Physical products linked to the app
• App/Platform: Mobile interface for Club House services
• Data: Info entered by the Consumer into the App
• Products: Tags and Labels sold or distributed by Clubhouse
• Clubhouse: Hole in One Shot Ltd, Dublin, Ireland

3. Licence

Club House gives a non-transferable license to use the App, Tags, and Labels. Intellectual property remains with Clubhouse. Club House may alter or revoke access to the App at its discretion.

4. App, Tag & Label Guarantees

Club House aims to support App functionality but does not guarantee uninterrupted use. Usage is at the Consumer's risk. The Consumer may stop using the App at any time by uninstalling it.

5. Product Guarantees & Liability

Club House provides a 1-year product guarantee for normal use. Damage from misuse or external factors voids this. Liability is limited to the product price or insurer payout. Indirect damages (like lost income) are not covered. Defective products may be repaired or replaced.

6. Data Processing

Data is stored on the Consumer's device and Club House systems. Club House takes reasonable security steps and may use data for service improvement and marketing. Consumers are responsible for third-party data they enter and must comply with privacy laws.

7. Data Protection & Sharing with Partners

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR). By using our services, you consent to the collection, use, and processing of your personal information as described in our Privacy Policy. We may share your data with trusted third-party partners for the purpose of delivering services, fulfilling purchases, improving our products, or providing customer support. These partners are required to process your data in compliance with GDPR and only for the purposes we specify. We will never sell your personal data. 8. App Services

Club House manages App performance and may conduct maintenance. No specific service level is guaranteed unless agreed in writing. Consumers must have compatible devices and infrastructure.

9. Termination

Club House may end access immediately if terms are breached. Consumers must then uninstall the App.

10. Other Terms

Governed by Irish law. Club House is not an insurance provider. Rights are non-transferable without written consent. Oral agreements are only valid when confirmed in writing. The Vienna Sales Convention is excluded.
